What is Fake News?
Fake news refers to deliberately fabricated or misleading information presented as legitimate news, designed to deceive readers, influence public opinion, or cause social disruption. In the Indian context, fake news has emerged as a serious internal security concern, linked to communal violence, mob lynchings, election manipulation, and erosion of public trust in institutions.
India's regulatory framework to combat fake news has evolved rapidly. The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 established the first comprehensive framework for content regulation on digital platforms. The 2025 Amendment tightened procedural safeguards, requiring only officers of Joint Secretary rank or above to issue takedown orders. The landmark 2026 Amendment (effective 20 February 2026) specifically targets deepfakes and synthetically generated information (SGI), mandating a 3-hour takedown for flagged misinformation and mandatory labelling of all AI-generated content.
The proliferation of generative AI and deepfake technology has dramatically escalated the fake news challenge. India now defines Synthetically Generated Information (SGI) as any audio, visual, or audio-visual content created or altered algorithmically to appear real or indistinguishable from genuine content.
